This Privacy Policy explains how MSB Data Ltd, a company incorporated in England and Wales under company number 17440655, with its registered office at 9 New North Road, London N1 6JB ("MSB", "we", "us" or "our"), collects, uses and protects personal data in connection with marketsalesbenchmark.com and the Market Sales Benchmark service (the "Service").
MSB is the data controller for the personal data described in this Privacy Policy.
For information about our use of cookies and browser storage, please see our Cookie Policy.
1. Personal Data We Collect
Account and Profile Data
When you register with MSB, we collect your first name, last name, login email and account credentials. Your password is processed by our authentication provider and is not accessible to MSB in plain text.
We also collect your participant type and base country and, where provided, your company and job title.
Verification Data
Participation in MSB is restricted to verified Financial Markets professionals.
As part of our one-time verification process, we collect the verification method you choose — professional work email, Bloomberg email or LinkedIn profile — together with the information you provide for that purpose. Your verification information may be different from your login email.
Benchmark Submission Data
When you complete a benchmark submission, we collect:
- the relevant asset class;
- the sales professionals on whom you provide feedback;
- your scores across the 7 MSB sales coverage dimensions; and
- any Star Sales designation you make.
We also associate your submission with your MSB account so that we can operate the benchmark, apply your selected privacy settings and maintain benchmark integrity.
Sales Professional Data
Respondents provide information about Financial Markets sales professionals as part of their benchmark submissions.
This may include the sales professional's first name, last name, employing institution, scores across the 7 MSB sales coverage dimensions and any Star Sales designation.
Sales professionals do not need to be registered users of MSB for respondents to provide feedback about the sales coverage they have received from them.
Technical Data
We may collect limited technical information necessary to operate and secure the Service, such as IP address, browser information and technical logs generated by our hosting and infrastructure providers.
We do not currently use advertising, behavioural tracking or analytics services.
2. How We Collect Personal Data
We collect personal data:
- directly from you when you create or manage an account, complete verification, contact MSB or submit benchmark feedback;
- from other verified respondents where they provide information and professional feedback about Financial Markets sales professionals; and
- automatically through limited technical information generated when you access or use the Service.
3. How and Why We Use Personal Data
We process personal data only where we have an appropriate legal basis under applicable data protection law.
Providing the Service
We use account, profile and submission data to create and manage accounts, authenticate users, enable draft submissions and process completed benchmark submissions.
Legal basis: performance of our contract with registered users under the MSB Terms of Use.
Verifying Eligibility
We process verification information to confirm that respondents are Financial Markets professionals and therefore eligible to participate in MSB. This may include manual verification where automatic verification is not possible.
Legal basis: our legitimate interest in protecting the integrity and credibility of the benchmark and ensuring that feedback is provided by eligible market participants.
Producing the MSB Benchmark
We process and analyse benchmark submissions, including information and professional feedback concerning sales professionals, to calculate benchmark results and produce:
- confidential sales-level reports for participating institutions; and
- aggregated public institution-level rankings and awards.
Legal basis: our legitimate interest in operating an independent industry benchmark of Financial Markets sales coverage.
In pursuing this interest, MSB applies safeguards designed to protect the rights and interests of both respondents and evaluated sales professionals. These include respondent verification, confidentiality controls, restrictions on public reporting, benchmark integrity controls and the prohibition of public individual sales rankings.
Maintaining Benchmark Integrity
We process account, verification, submission and technical information where necessary to identify duplicate submissions, unusual scoring patterns, conflicts of interest, fraudulent activity and attempts to manipulate benchmark outcomes.
Legal basis: our legitimate interest in preventing misuse and maintaining the fairness, reliability and integrity of the benchmark.
Communicating With You
We use your contact information to send essential account and Service communications and to respond to enquiries or requests.
Legal basis: performance of our contract with you where the communication relates to your account or use of the Service, and our legitimate interests in administering the Service and responding to enquiries where appropriate.
4. Information About Evaluated Sales Professionals
MSB processes professional information and feedback concerning Financial Markets sales professionals even where those individuals have not registered with MSB.
This information is provided by verified market participants based on their experience of the sales coverage they have received.
MSB uses this information for the purpose of producing its independent benchmark of Financial Markets sales coverage.
Individual sales-level results are never published publicly.
Sales-level feedback may be included in confidential reports made available to the relevant participating institution in respect of its own sales professionals. Public MSB results are limited to aggregated institution-level rankings and awards.
MSB applies safeguards designed to ensure that this processing is proportionate to the purpose of the benchmark and to protect the rights and interests of the individuals concerned.
Evaluated sales professionals may exercise the data protection rights described in Section 10 of this Privacy Policy.
5. Who We Share Personal Data With
We may share personal data with the following categories of recipients:
Service Providers
We use third-party service providers to operate the Service, including providers of database infrastructure, authentication, website hosting and related technical services.
These providers process personal data on our behalf and are required to handle that data in accordance with applicable data protection requirements and their contractual obligations to MSB.
Our current principal technology providers include Supabase, which provides database and authentication services, and Vercel, which provides website hosting and related infrastructure.
Participating Institutions
Confidential sales-level feedback is shared only with the relevant participating institution and only in respect of its own sales professionals.
Information about the respondent accompanying such feedback is displayed in accordance with the respondent's selected privacy option and MSB's confidentiality safeguards.
Public Reporting
MSB may publish aggregated institution-level rankings and awards.
MSB does not publicly publish individual sales-level results.
Legal and Regulatory Requirements
We may disclose personal data where required to do so by applicable law, regulation, court order or a competent regulatory or public authority.
We do not sell personal data to third parties and do not use personal data for advertising purposes.
6. Respondent Privacy & Visibility Choices
When registering with MSB, respondents select one of three visibility options governing how their information may appear in connection with confidential sales-level reporting.
Full Anonymity
The respondent is displayed as Anonymous.
Partial Visibility
Only the respondent's base country and participant type may be displayed.
To reduce the risk of identification, this information is displayed only where at least two respondents providing feedback on the relevant sales professional share the same combination of base country and participant type. Where this threshold is not met, the respondent is displayed as Anonymous.
Full Visibility
The respondent's name, organization, base country and participant type may be displayed.
These visibility choices determine how respondent information is presented in confidential reporting. They do not affect MSB's ability to process the underlying benchmark submission in accordance with the purposes and legal bases described in this Privacy Policy.
7. International Data Transfers
MSB is based in the United Kingdom and seeks to host and process personal data within the United Kingdom and European Economic Area where reasonably practicable.
Some of our service providers may process or access personal data from countries outside the United Kingdom and European Economic Area.
Where personal data is transferred outside the United Kingdom or European Economic Area, MSB uses safeguards required by applicable data protection law, where applicable, such as an adequacy decision or the UK International Data Transfer Agreement / Standard Contractual Clauses.
8. Data Retention
MSB retains personal data only for as long as reasonably necessary for the purposes for which it was collected, including the operation and integrity of the benchmark and compliance with applicable legal obligations.
Different retention periods may apply to different categories of data.
Account and profile data is retained while your account remains active and for an appropriate period following account deletion where necessary for legal, security or administrative purposes.
Verification data is retained for as long as reasonably necessary to demonstrate and maintain the integrity of MSB's respondent verification process.
Benchmark submission data may be retained beyond the life of a respondent's account where necessary to maintain historical benchmark results, reports, auditability and benchmark integrity, subject to applicable data protection law.
Aggregated or anonymized benchmark data that no longer identifies an individual may be retained for longer periods, including for historical benchmark analysis.
MSB will establish and periodically review appropriate retention periods for each category of personal data.
9. Security
MSB implements appropriate technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, alteration or disclosure.
These measures include controls relating to authentication, access management, data transmission and database security.
Access to non-public benchmark information is restricted according to operational requirements and user permissions.
No information system can be guaranteed to be completely secure, and MSB cannot guarantee absolute security.
10. Your Data Protection Rights
Subject to applicable data protection law, you may have the right to:
- request access to personal data MSB holds about you;
- request correction of inaccurate or incomplete personal data;
- request deletion of your personal data in certain circumstances;
- request restriction of certain processing;
- object to processing based on legitimate interests in certain circumstances; and
- request portability of personal data where the legal requirements for data portability are met.
These rights apply both to registered MSB users and, where applicable, to sales professionals whose personal data is processed as part of the benchmark.
Where MSB processes personal data on the basis of legitimate interests, you have the right to object to that processing in accordance with applicable data protection law.
The exercise of a data protection right does not necessarily require MSB to delete or cease processing all information relating to an individual where MSB has another lawful basis or compelling legitimate grounds to retain or continue processing that information.
To exercise your rights, please contact us using the details in Section 14 below.
You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) in the United Kingdom or, where applicable, another competent data protection supervisory authority.
11. Children's Privacy
The Service is intended exclusively for Financial Markets professionals and is not directed at or intended for use by individuals under the age of 18.
MSB does not knowingly seek to collect personal data from children through the Service.
12. Cookies and Browser Storage
MSB uses limited browser storage and related technologies necessary to provide authentication and other essential Service functionality.
MSB does not currently use advertising or analytics cookies.
Further information is available in our Cookie Policy.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to the Service, our processing activities, applicable law or our business practices.
The date of the most recent version will be shown at the top of this Privacy Policy.
Where changes are material, we may also notify registered users through the Service or by email, as appropriate.
